Terms of Service

If the terms of service are respected, any person can use the services provided by CaptainForm. In case of suspicion around illegal activities, we hold the right to disable accounts.

In order to create and maintain accounts, we gather the bare amount of personal information that is needed. Personal information can be accessed and updated under the My Account section. Your personal information will not be disclosed or sold to anyone. We shall never read the messages received through your forms. All information recorded by the user's forms are private and can be used exclusively by the account owner. Except for the case in which authorities request your IP, personal information and received data, they are confidential. Our marketing messages will always include an opt-out mechanism.

Submissions are stored securely on our Amazon cloud servers, and are protected against interference, misuse and loss, as well as against unauthorized access, modification and disclosure.


All users, regardless of the plan they choose, can create secure forms (SSL Encryption is enabled by default) and can choose to encrypt submission content from the section My Account (simply turn Data Encryption on).

Antispam policy

To show our policy and action against spam, we implemented CAPTCHA and reCAPTCHA protection. In case spammers go past our CAPTCHA protection, please let us know and we will increase the difficulty of the CAPTCHA.

To further our antispam action, we have implemented Smart CAPTCHA, which activates when more than one submission comes from the same IP address. Also, submissions from the same IP address can be restricted to one or a few per day.

Abuse policy

It is absolutely prohibited to create web forms that ask for sensitive data (i.e. passwords, email credentials and any type of credentials, credit card information). Forms that violate these terms will be quickly deleted and the accounts will be blocked. If you need to receive payments from your clients, we offer 10+ user-friendly payment processors. For assistance in choosing a payment method, please contact us via the form in the footer. Through a form validation script, we are tracking down and banning all forms created by the users of our service that are used for data phishing purposes.

Anti-racism policy

We are against the usage of our service for activities related to racism, segregation, religious hatred or any other illegal activities. Accounts which are involved in such actions will be immediately disabled and actions will be taken against the user.

Account limitation

Access to a user's account may be restricted for the following reasons. Upon solving the issues, access will be granted to all complete submissions.

  • Payment problems. Upon failing to make the yearly payment for your account, you will have 7 days to resolve the issue, otherwise you will have limited access to your account and it will be scheduled for downgrade to the Regular plan after 15 days. While your account is limited, you can access it and your forms, but you will receive only incomplete submissions and you will be unable to access your form settings and submissions. If the payment problem is taken care of within the 15 days, the account limitation will automatically be lifted and it will no longer be subject to a downgrade.
  • Too many submissions. If you are subscribed to the Regular plan and you receive more than 500 submissions per month, you will receive incomplete submissions, at first. If this continues for the following months, your account will be suspended. This is caused by a larger amount of bandwidth that we cannot offer for free. Upgrade to the Apprentice plan to receive a higher number of submissions.
  • Phishing or scam. All forms used for phishing purposes will be suspended. Owners will be unable to log in and forms will not be functional.

Free accounts

Regular accounts can receive at most 500 form submissions per month. The number of submissions is calculated for all existing forms in an account, and not for each form separately. The submission counter is reset on the first day of every month. For example, if you create an account in the middle of the month, the counter will be reset on the 1st of the following month, then, on the 1st of the next month, and so on.

In case an user exceeds the submission limit in one month, the exceeding submissions will be added over to next month. If the submission limit is exceeded repeatedly (for three months), the account will be limited. Exceeding the submission limit will result either in receiving incomplete messages or in having the account suspended and not receiving any messages at all. In order to set the submission limit higher, you are required to upgrade to a paid plan.


In order to create forms with advanced features (i.e. multiple recipients, conditional logic, PDF notifications etc.), users are required to upgrade their accounts to the Apprentice, Master or Hero plans. Subscription payments are handled by Avangate, our third party payment processor. In case of subscription payment failure (reasons being expired credit card, insufficient money etc.), you will have 15 days to resolve this issue; otherwise, the account will be downgraded to the Regular plan.

Subscription cancellation

If you sign up for a paid plan, you will be charged automatically on a yearly basis from the payment source you have initially provided. If you wish to terminate your subscription, you will need to cancel your subscription from the section My Account. Recurring payments continue until you cancel your subscription. You can also contact us if you need help with the cancellation process.

Changing payment details

Changing payment details equals to a new subscription. If, for example, you have an Apprentice plan subscription and you upgrade to a Master plan on a later date, we can either refund your initial payment (if you are in the first 30 days) or prorate the amount to the new plan. Your yearly subscription date will be the one when you purchased the second plan.


We have a 30-day money back guarantee policy. In case of mistaken duplicate payments or unlawful orders, we will refund the money immediately. Refund requests for reasons such as "I did not understand what your service offers, I thought it is a one time payment, not a subscription, I don't like how the form/code looks" after the initial 30 days are not accepted. We consider the amount of information on our website and in our plugin is sufficient for users to make an informed decision.

Order forms with payment integration

Hero plan users can create forms with payment integration that can collect money from visitors. CaptainForm does not accept any liability for the contracts that are not respected. Payment disputes between form owners and their customers must be resolved only between them, without involving CaptainForm, which simply provides a service for collecting payments and does not take any responsibility for such issues.

Digital signature

The digital signature available through our service is provided "as is" with no express or implied warranty for compliance with state laws. CaptainForm is not liable for the the legal validity of the electronic signatures collected within our forms. The only person responsible for the validity of the signature provided is the form user.

Service availability

Our services are hosted on Amazon Web Services (AWS), which is one of today's most secure cloud computing service provider. They offer the most stable and scalable hosting services, great uptime, quick support. Data is encrypted and kept securely on Amazon's servers in multiple data centers located across the United States. We upgrade our AWS account whenever necessary and install the latest security packages when they are available. However, there is the possibility for temporary downtimes outside of our control, which is possible for any other website. It happens on rare occasions and, when it does, we will announce this and we will do our best to solve the problem as soon as possible.

In order to avoid any issues and minimize latency, please email us 1-2 days in advance at support@captainform.com and let us know if you expect a submission rate higher than 5000 per day or another large wave of submissions. We will take all the precautionary measures to prevent any latency. However, we are not responsible for any data loss that might occur to you when the server is not accessible. If you have a commercial website, we cannot be held responsible for the data loss; the best we can offer you is a partial/full refund of the money you paid to us.

VAT levels

CaptainForm is located in the European Union (EU), therefore we are subject to the Council Directive 2002/38/EC regarding European regulations on software VAT. Inside the EU, the VAT rate varies between 15-25%. This is dependent on the rate determined by the member state the customer is located in. Companies or taxable persons are not charged VAT, only if they have registered for a VAT ID number. This is provided that the annual sum exceeds a level established by their country of residence.

Individuals and businesses from outside of the EU will not be charged VAT. To find out more about the VAT rate of your country, follow the list here.
